Welcome to The Brighton Flame, where we preserve stories in scent. This website, thebrightonflame.com (the “Site”), is operated by The Brighton Flame (“we,” “our,” or “us”). These Terms of Use govern your access to the Site and purchases from our shop. By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

Website Use

You must be at least 18 years old, or have permission from a parent or guardian, to use this Site. You agree to use the Site only for lawful purposes and in accordance with these terms. We may refuse service where permitted by law.

Product Information

We take care to present our candles, fragrance descriptions, prices, and availability accurately. Even so, occasional errors or omissions may occur. We may correct inaccuracies, update product information, or cancel an order affected by incorrect information, including after an order has been submitted. If we cancel an order for which payment has been collected, we will refund the cancelled items. Updates may be made without advance notice, subject to applicable law.

Orders

By placing an order, you confirm that the information you provide is accurate and complete and that you are authorized to use the payment method selected. Orders may be reviewed or cancelled to help prevent fraud. We may limit or cancel quantities purchased per person, household, or order, where permitted by law.

Payment

Payments are securely processed through the payment services available at checkout, which may include Shopify Payments, Shop Pay, or PayPal. The Brighton Flame does not store your full credit card information. Prices are shown in U.S. dollars unless otherwise indicated.

Shipping

We prepare and ship orders using the shipping services available for your order and destination. Delivery estimates may vary with carrier operations, destination, customs processing, weather, and other circumstances beyond our control. We cannot guarantee carrier delivery dates and are not responsible for delays outside our control, except where applicable law provides otherwise.

Shipping Destinations

We currently ship within the United States only. International shipping is not available at this time. Available U.S. shipping options and rates are shown at checkout.

Returns & Refunds

We accept returns for refunds within 30 days of delivery. Returned products must be unlit, unused, and in resalable condition. Please use the original packaging whenever possible and pack your return securely. Candles that have been burned or used are not eligible for return.

Contact us before returning an item so we can provide instructions. Customers are responsible for return shipping unless the item arrived damaged. Refunds are processed after the returned items have been received and inspected. Original shipping charges are not refundable, except where required by law.

Damaged Items

If your order arrives damaged, email thebrightonflame@gmail.com within 48 hours of delivery. Include your order number and clear photographs of the damaged item and its packaging, if safe to take them. Once we verify the damage, we will arrange a replacement. Do not burn a candle in a cracked or broken vessel or mail broken glass back without instructions. This reporting window does not limit rights provided by applicable law.

Lost Packages

If tracking shows delivery but you cannot find your package, please contact us with your order number and tracking information. We will help you investigate. At our discretion, we may offer one replacement shipment as a courtesy; a courtesy replacement is not guaranteed. This does not affect any rights you may have under applicable law.

Product Safety

Every flame deserves care. Use candles responsibly and follow all safety and care instructions supplied with your purchase.

• Always keep a burning candle within sight.
• Keep candles away from flammable materials, drafts, children, and pets.
• Place candles on a stable, heat-resistant surface.
• Follow the wick-trimming, burn-time, and end-of-use instructions provided with the product.
• Never burn a candle in a damaged vessel.

To the extent permitted by law, The Brighton Flame is not responsible for damage or injury resulting from improper use or failure to follow product safety instructions.

Intellectual Property

Our original photographs, videos, product designs, graphics, logos, written content, branding, and website design are owned by The Brighton Flame or used with permission from their respective rights holders. Applicable copyright, trademark, and other intellectual property laws protect this material.

Unless we give prior written permission, you may not reproduce, copy, modify, distribute, or use our protected content for commercial purposes, except as otherwise permitted by law.

Artist Collaborations

Some collections or products may feature work created with independent artists. Unless otherwise stated, the artists retain ownership of their artwork. Please obtain permission from the appropriate rights holder before reproducing or redistributing that work.

User-Generated Content

When you submit a review, photograph, comment, or other content to us, or tag The Brighton Flame in content on social media, you grant us a non-exclusive, royalty-free license to use, reproduce, publish, and display that content for shop marketing and promotional purposes, to the extent you have the right to grant that permission. You retain ownership of your content. This permission does not transfer ownership to us or restrict your ability to share an honest review.

Unauthorized Resale

Retail purchases are intended for personal use or gifting. Resale through third-party marketplaces, including Amazon, Walmart Marketplace, or other online marketplaces, requires prior written authorization from The Brighton Flame. Approved wholesale arrangements are governed by their agreed terms. Unauthorized resale may result in order cancellation or refusal of future purchases, where permitted by law.

Limitation of Liability

To the fullest extent permitted by applicable law, The Brighton Flame will not be liable for indirect, incidental, special, or consequential damages arising from use of this Site or the purchase or use of our products. Nothing in these terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

Governing Law

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Subject to any mandatory consumer protections or venue rights that apply to you, disputes arising from use of the Site or purchases from our shop will be brought in courts located in North Carolina.

Changes to These Terms

We may revise these Terms of Use from time to time. Updated terms take effect when posted on this page, and the “Last Updated” date will identify the latest revision. Changes apply prospectively and do not remove rights you already have under applicable law.
